On the 29th of December 2012, the French « Xavier Betrand » law strengthened the control of financial relationships between healthcare industry and HealthCare Professionals (HCPs) as well as HealthCare Organizations (HCOs) by introducing a new provision (article L.1453-1 of the Code of Public Health) which enforces the public disclosure of all the advantages provided to HCPs, HCOs and third parties.
Thus, from 2013, healthcare industry will have to display all the advantages provided to:
- Healthcare professionals
- Healthcare organisations
- Third parties such as events agencies, press organizations, hospitals, consulting firms …
A new decree will precise soon the details of the information to be disclosed. This decree should be made available within the next weeks. There were several versions of this decree with modifications on the content of information to display as well as changes to the frequency of reporting and on the financial threshold to comply with.
According to the latest news, this first disclosure could occur in next September on financial relationships collected during the first semester of 2013. The exact amount of monetary advantages would be displayed for each HCP and each HCO concerned (whereas in the previous version the amount of advantages just had to be ranked according to predefined thresholds). Lastly, a question about the website where this information would be published (on the company’s or on a third party’s) is still pending: a centralized website could be chosen.
